Terms of Service

These Terms of Service ("Terms") govern your use of the Presented Home Staging website and staging consultation service (the "Service"), operated by Presented Home Staging ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Presented Home Staging provides AI-assisted, human-reviewed staging consultations, and may offer additional add-on consultations (such as cleaning consultations) from time to time. You upload photos of a property, and we provide recommendations intended to help prepare the property for listing photos and showings.

The Service does not include: physical staging, cleaning, moving furniture, purchasing or renting furniture or decor, or any on-site work. All recommendations are advisory only.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 18 years old to use the Service.

3. Payment and refunds

Consultations are paid in advance of report generation. If we do not deliver your consultation report within 5 business days of submission, you are entitled to a full refund. Once a report has been delivered, payments are final. If you have questions or concerns about your report, you may contact us through our website.

We reserve the right to change pricing at any time; changes will not affect consultations already paid for.

4. Your content

You retain ownership of the photos and information you upload ("Your Content"). By uploading Your Content, you grant us a limited license to use it solely to generate and deliver your staging consultation, including processing it through third-party AI services (see our Privacy Policy for details).

You represent that you have the right to upload the photos and information you submit, including any necessary permission from homeowners, sellers, or other property owners depicted in the photos. We recommend avoiding photos that include identifiable people wherever possible.

We do not use uploaded photos for facial recognition or identification purposes. Photos are used solely to generate staging recommendations for the property depicted.

5. Staging recommendations are advisory

Recommendations are generated with the assistance of artificial intelligence and reviewed by our team, but they are general guidance, not a guarantee of any particular sale price, showing outcome, or buyer interest. You are responsible for evaluating whether any recommendation is appropriate for your specific property, client, and local market.

We are not responsible for costs incurred in following our recommendations (e.g. purchasing decor, hiring movers, or other staging expenses).

6. Acceptable use

You agree not to:

• Upload photos you do not have the right to share
• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or misuse the Service or its underlying AI systems
• Upload content that is abusive, infringing, or otherwise inappropriate

We may suspend or terminate accounts that violate these Terms.

7. Intellectual property

The Service, including its design, software, and the Presented Home Staging name and branding, is our property. The staging report we deliver to you is yours to use and share for the purpose of marketing the applicable property listing.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or usefulness of any recommendation.

9. Limitation of liability

To the maximum extent permitted by law, Presented Home Staging and its owners, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid for the applicable consultation.

10. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Colorado.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
